Look, both have married before, but she was not speaking very good English at the time..he fooled her into signing a pre-nup and called it a paper conditional towards buying their condo...she signed it, not knowing better and trusting her new husband...
now he took their daughter to his mother's house and told the cops that he wanted her out of the house...now..he has persuaded the leaders of our church that he is right and they are not willing to help her at all..
I can't help to think that HE has kidnapped his own daughter and LIED to the cops about her being dangerous in order to validate his decision...
my wife and I know her REAL well and have NO problem having her babysit our kids...she has looked over them SEVERAL times without any problems
the "dangerous" thing is a BS excuse..
Does SHE have ANY rights at all??? What can she take this ahole for??

She can petition the court for custody. She can do this on her own but I recommend she get a lawyer. If money is a issue, she can go to legal aide. there she can get help for a low fee or sometimes even free. Yes, she has rights. As a wife and as a parent. Sounds like he is bullying her to get his way.

Did he kidnap the daughter? He is the child's father and when divorce occurs, usually the child goes to live with one parent or the other. Just so happens that the father took hold of the kid. What she needs to do is find a good lawyer and a way to prove that she didn't understand the pre-nup that she signed, but that'll be difficult. As for custody, perhaps he deserve it more, I don't know.

What's fascinating is that if the roles were reversed (e.g. he were the wife leaving) "she'd" be doing nothing wrong at all taking the kid to her mother's house and kicking the husband out. That happens every day and no one asks twice about it. I think he knows the legal system a whole lot better than she does, (possibly because some a lawyer is advising him behind the scenes) and it sounds like she'd better move quick and get her own lawyer unless she wants to play the guy by not ever seeing the kid, paying out 80% of her paycheck in childsupport and eating dogfood under a highway overpass. Once the wife (or husband) in this case, gets this far ahead legally, they can usually crush you in court. Which makes him (her) act angrily, which results in more rights getting taken away.

There is always two sides to every story and that is why we have courts, attorneys and judges. Seems to me you may want to contact a lawyer and see what he has to say about all of this. This does not look like any of it is all that simple. You may want to help her out somehow if she doesn't speak good english. She will definitely need some help communicating.

She needs a good family law attorney. Without legal representation, she cannot do anything.
If money is a problem have her try a local law school. Usually there are hoards of eager young lawyers wanting to cut their teeth hanging around a law school.

Sounds like he is white and she is Hispanic and he probably used her and now she "is not good for him anymore" the truth is there is always two sides of the story, but even though the pre-nup DOES NOT aply to the children, they are not "things". You need to help her to get a good family law attorney.

prenups do not work on any asset bought during a marriage
a house is definetely one of them
have her file for divorce
have her get an attorney
he either buys her out or the home is forced sale and net proceeds are split 50/50
then she should sue for sole custody and child support
