My band and I (from around Toronto, Ontario) signed a contract to a record label when we were all under 18. The record company owner was aware of this. Now, 8 months before the contract ends, we want to drop the label. When we signed it, we were under the impression that we couldn't be legally binded by a contract. Now, ONE of the members, turned 18. Are we now legally binded by the contract, or no?
Basically, since ONE member is now 18, can we drop the label we're signed to and not be legally binded? Or since we were all under age when we signed the contract, did it immediately become null or void?
I know very, very little about this sort of legal stuff, so any input would be much appreciated.

Did a parent or legal guardian sign the contract as well? If so it could be enforceable. If not it should be null and void.

Signing a document as a minor always has the potential for controversy. Though the label might try to use the fact that one of you are 18 now, don't listen. As a minor, you are not yet legally binded to anything without a parental signature, even if you are now older. What will help most with this is if the contract is dated. That gives evidence that at the time, no matter how old you are now, you were underage, and cannot be held legally responsible. Except, of course, if a parental signature is located on the document.... then you're screwed.

First Im not a lawyer,so I would find a lawyer whom deals in contracts and let him look it over.Second(I dont know if laws are different between the US and Canada) If any of you were emancipated minors during the signing,that could hold you as an adult to the contact.Third,since the contract is in and for the entertainment media,there may be stipulations that disregard your age at signing.(since their are children on TV and in music groups that are binded by their performance contracts) so the best advice is take your contract and talk to a lawyer,before you make any rash decisions.

A contract can be unenforceable if a minor negotiated and signed the contract.

That means a party will not be able to enforce conditions of the contract against said minor.

Minors can void (voidable contract) or ratify (upon reaching the age of majority) their contracts.

The other party is entitled to return of the goods back from the defendant-minor or can avoid the contract if a minor lied about her age.

I think the contract can't be binding because of the ages when signed. My son signed for a credit card when he was 16. The offer was sent to him in the mail. He got the card and proceeded to the mall where he spent $2000 in one day. He couldn't pay the bill, and I wasn't going to because I knew nothing about him getting the card in the first place. A lawyer told us that the contract wasn't legally binding because of his age and we didn't have to pay the bill. This scenario is what I base my answer on.

Signing a contract as a minor makes the contract voidable.

Next time don't get into any contracts that big without hiring a lawyer to assist you through the process.

If YOU are not yet 18, then you can back out of the contract whenever you want to.
