http://video4people.blogspot.com is a video of a phone message from a mother to a daughter and you see the daughter's reaction and the video goes on quite painfully but it's a mixed bag as to what the ramifications of posting this are if there is no money or libel involved, just to show people there are worse phone messages than Dog Chapman and Alec Baldwin!

http://video4people.blogspot.com can only be damaging to the girl in the video crying as her mother screams into the answering machine unhampered so I guess just as though no one knows the name of http://video4people.blogspot ' s daughter's mother than it is fine. The daughter that videotaped it already consented to her name as well as her friend who the mother mentions quite clearly and who the daughter mentions too, so it seems okay just something to learn from and know that there are even worse voice mails to family members from their mothers and fathers than just Dog Chapman to his son and Alec Baldwin to his daughter! Listen for yourself and make the determination, it's very interesting to hear this!

Well the thing that is wrong with it, is that it has very explicit language. Although I do agree, it does make a good statement that there are worse messages than Alec Baldwin, and Dog the Bounty Hunter, and for that you should be able to make this public. However, in order to do that, you might have to get some of those things bleedped out. I think you should be able to make it go public anyway to prove your point though. Hope things get better for that poor woman, I hope her mother burns in hell.

As it appears this was a voice mail or answering machine message she should not have an expectation the message is not being recorded. The courts have held that a person leaving a message is by their actions consenting to being recorded. Since both parties consented to the recording it should be legal in all 50 states.

She has no basis for claiming slander as you are using her words unaltered.

I can see no issue with displaying the video or sharing an audio file of the message.

The legal issues depend on in what state the recording was made. Without that, there is no one who can tell you the consequences.

I would also need to know the context of the message: was it live or a recording/voice mail.

the only problem i can see is - perhaps - making something private public --

if she were to sue her lawyer would probably look at invasion of privacy - but not entirely sure that's a winning argument - (depends on the state, court, etc)

as a general rule of thumb, i'd say, if you're not sure something like this is legal then just don't do it -

Good luck

Did she agree to let you post it on the Internet? It may have already been out there but that doesn't mean you have to help circulate it.
