It really depends on who has legal custody of the child. Another factor is whether the mother/father are married, if not then the mother has parental rights.
In the long run, if a court order is obtained, then the judge will have to decide whether the fathers petition is acceptable or not. Ultimately, is this just an attempt to get back at the mother?

The father can get a court order if he makes a reasonable and coherent argument and the judge agrees with him.The father should have been consulted before the decision to move school was made but is forcing the child the back to their old school the best thing.It sounds to me that what this child needs is a little stabilty at the moment so the father should ask himself if moving the child back is the best thing for the child or just trying to get one back on the mother

Not if the Mother has legal custody. You can't control another persons life by claiming it's for the childs good. Kids are resilient and can adapt to change.

IDK, but whatever my two cents is worth, just dont do it..you ex will fight it, and the attorny bills suck, and thats not fair for any of you, least of all the child. I mean if you kid like the old school better and you live in the district, then the judge might be like well, okay, live with dad over the wk, and mom over the weekend, but it also depends on the lawyers you both have, and also the judge...personally, leave them alone, its not worth being able to map out the court house with you eyes closed....

If the child is happy leave her there. Getting Court Orders just to get back at the ex-wife is not good for anyone involved.

if they were married ,yes, if they werent he hasnt got parental responsability, and if he aint got that he hasnt much say in the matter. think is it in the childs BEST interest to be from pillar to post, leave the kid alone,,, but if its best interest are to get courts involved , go for it .
