In India including all big or small cities, towns & villages the domestic violence law is basically made only recently as THE PROTECTION OF WOMEN FROM DOMESTIC VIOLENCE ACT, 2005, for the purpose to provide for more effective protection of the rights of women guaranteed under the Constitution who are victims of violence of any kind occurring within the family and for matters connected therewith or incidental thereto. Under this Act only any woman who is, or has been, in a domestic relationship with the respondent and who alleges to have been subjected to any act of domestic violence by the respondent is considered the aggrieved party & it doesn't provides any relief for any man in a domestic relationship against whom any domestic violence has been inflicted by any one. This Act is both preventive as well punitive in nature for the offence of domestic violence when inflicted on any aggrieved woman in domestic relationship. The complaint against any domestic violence under this Act has to be made by the aggrieved woman in person either in the form of information to the Protection officer appointed under this Act or in the form of application to the Magistrate. In both the cases the presence of the aggrieved woman in the place where such domestic violence was inflicted on her i.e. town/city/district/state/country, hence if any woman not physically present in the country itself cannot make such complaint against such domestic violence, but it will also be seen what type of information or complaint such an aggrieved woman wants to make for the domestic violence, for whom & against whom, what are the actual facts of the case & circumstances leading to such information or complaint against such domestic violence. Any woman sitting in a foreign country can face domestic violence too not necessarily in the physical form but in the form of mental harassment, like unlawful dowry demand, verbal and emotional abuse and economic abuse etc which are all covered under the definition of domestic violence. Even such cases will be covered under this Act & any information regarding such domestic violence can be made by such aggrieved woman to the Protection officer of the district from where this was inflicted on her. Her presence will be required by this protection officer at the time of making a complaint with the magistrate for taking action against the person or persons who inflicted such domestic violence against the aggrieved woman. Even well-educated men & women in urban areas are not aware of such laws and in semi-urban areas also purdah system still exists and if a wife says anything against husband, then that lady is blamed and no one says anything to the husband. Legal system is very bad there and it is next to impossible to get justice since corruption level is extremely high. This is almost applicable throughout and not just one area.
