I was leaving my girlfriend's place last night when the trouble started. As I walked to the door, I reached for the Twix candy bar that I'd set on the kitchen counter earlier. She grabbed my hand and told me that it was her Twix, and that I should "check my mitts." I knew she was only kidding, so I decided to play along, wrestling her into the living room. But then she took it too far, pushing me into the stack of CDs she's piled up on her floor. I stepped on a few, and knew immediately that I had broken some.
I looked down at the floor and realized that I had stepped on, and broken, my very own Tevin Campbell CD that she'd borrowed. Needless to say, I was heated. Tevin Campbell is, arguably, the greatest entertainer my generation has produced. Anyway, this was an autographed CD, and it can't easily be replaced. She says she'll buy me a new CD, but I feel that's not enough. I want her to pay me for the value of the signed CD. I'd say it was worth about $500. Who's right?

Well, you should have known better than to put your mitts on her Twix. That tasty, cookie, caramelly goodness was all hers. You need to eat the cost. 'Nuff said...

First: Do you want a girlfriend or not?

Second, as far as legal rights, you would both be at fault. The legal doctrine is called comparative fault. If you went to court, you would probably see some sort of split.

Also, regardless of Tevin Campbell's stature, the CD probably is not worth $500. You look at what it would go for on the open market. You might be able to get $20-50 for it. That is the most you would get in court.

Oh, you are SOOOO in the wrong here man. Just eat it. It was an accident and no one's to blame. It could just as easily have been her falling into a lamp or something... I know... the autographed cd and all... Well, it's not like Tevin's done anything this century. There's a good chance, the cd might only be worth .25 at a garage sale.

I'd say your relationship with her is far more important.

Grow up. You were both wrestling. She didn't step on it you did. And even if she did I would still tell you to grow up. It was just as much your fault as hers. You shouldn't expect a thing from her.


PS: You aren't doing your generation any favors by asking that question.

She shouldn't have to pay you $500. It still won't replace the CD. Just have her buy you a new one and she'll still be indebted to you.
