this" Q "pertains to my daughters divorce decree, the divorce papers stipulate that my daughter will keep her vehicle & that she pay 1/2,he pay 1/2 of the loan. now 6mos later due to a $ crunch he wants to be relieved of the debt. this is where my Q comes from. he tells her that becuz of his enlistment in the army that she has no recourse in court.(btw )both names are on the title & loan. thanx in advance to all .

She can take him to court - but there may be certain circumstances which limit the exact actions she can take. If he wants to be relieved of his half of the debt - he has to ask for a modification of the original divorce decree/support agreement. He can't just stop paying.

Do a search for the "Soldiers & Sailors relief act" and you should be able to find some additional information there. Also - contact an attorney who specializes in military law.

Another option is to contact the soldier's commander. That can accomplish a lot of things when normal "channels" cannot.

One thing to remember - *you* will not be able to take legal action on your daughter's behalf. She will have to see the attorney and do what it takes to get things done.

If she has a problem getting him to pay, forget taking him to court, all that will do is waist time... I mean she has the proper paper work that states he owes 1/2. PERIOD.

Take it to his first shirt, have her explain what is going on and believe me, the first shirt will make sure it is automatically deducted. The military frowns on stuff like this. Have her take the paper work to show that he owes, and if for some reason, which is highly unlikely, if he wont help, then go to court. She has a winning case either way... Best of luck to her!

Yes she can take her ex to court. In fact the military does not look favorably on men that don't abide by the court rulings. And since the divorce stipulated that he pay half, he needs to pay half. If you get no response from him, contact your congressman and ask for help getting in touch with his commanding officer. They will straighten him out and fast.

Call his company commander and talk to he or she about this. I am sure they would love to help you put a BOOT up his pants. His debt has nothing to do with his service in the military.He should pay what was decreed in the courts. seriously call his commander of his company and talk with them.

This is easy!! Write a polite/detailed letter to his 1st sgt/commander, send copies of the court documents with the letter!! Thank them in advance for their help, and he'll be on KP for the rest of his tour!! They will explain the details to him, in a manner, that he will understand, and be grateful to pay his part!!!

That's a load of crap. Tell her to speak with his commanding officer. That will take care of the whole thing. Trust me.

Yes maam she sure can and him being in the military will get him in even bigger trouble for not paying his debts. Get him!
