My brother has tried to open a bank account but doesn't have a current photo id. He says it is not law to provide one. I say it is. Who is right?

Yes, most if not all, banks require a photo ID.

Well....if they wouldn't let him open the account without the ID, then it is probably the law. Or at least the bank's policy (which they have the right to have).

So you are right.

Due to the PATRIOT act, they can require photo ID now to open an account, where it was not required in the past.

Yes, they would need an ID, plus your social security number, now if you are under 18, and an adult is co-singing for the account for you, then an ID might not be necessary.
