Most small companies do not offer 'paid vacation.'

What employee benefits were you offered when you were hired?

Paid vacation is a benefit, not a matter of fact. Unless there is a specific benefit plan in place that says you get paid vacation, then no, he doesn't have to pay you.

If you took the job with the promise of paid vacation, then he has to honor that, since vacation (if it exists) is part of your compensation.

However, in the United States, there is no legal requirement to offer vacation time at all.

Do you have a vacation policy in writing were you work? If so then if you gave him plenty of notice then yes he has to if not then you are SOL.
