I have two kids by the same man. I have always had them other than an occasional weekend when I would let their dad have them. He has never paid child support although he was told to by the state. No job, does drugs, no house ect. But I have never filed for legal custody as he only calls about every six months so I wasn't worried. Well, the other day he showed up at my sons school and told him only a few more days and they would be together for good. So I am wondering what rights do I/He have? In Missouri by the way!!

Thanks to all who replied...I knew I needed to get a lawyer but they are so darn expensive but in the end I have decided to use my Oh **** $ and proceed w/ the whole thing as for putting it in two forums I wanted plenty of answers....

You need to talk to the police, & get a lawyer very quickly.
This sounds bad, but get height, weights, & take pictures of them from ALL angles. Make sure you don't wash at least one piece of clothing of each of theirs, in case they use dogs to find them.
Precautionary, but it may help if it hits the fan. How many of us have *recent* pics of our kids? The one in my wallet is from last year, & he is 6 inches taller & 30 lbs heavier.

You need to see a lawyer and do the following right away:
1. Get a temporary protection order.
2. Get legal custody established by the court.

With out legal custody he has as much right to custody as you do. While it is very likely you would win in court, without full custody there is a lot less you can do to protect your children.

You need to do what Davidmi711 said, only I'd add that the school needs to be made fully aware of the situation and the lawyer needs to file for an emergency hearing with the court, otherwise it could take weeks to see the judge.

I think you need to be very concerned. Notify the local police and the school, and go to court to get custody ASAP. PS: He may just be trying to weasel money out of you. That he's never paid child support will definitely work against him, but he may try to steal them, so watch out. Tell your kids exactly what to do in this situation (scream, scratch, bite, kick for the balls, etc.)
