Contact Paypal to dispute the transaction and then they will freeze the sellers account until it's resolved.

hi, i am an e-bay seller and if this happened to youwhat you need to do is get back in touch with the person who you gave the money to and ask him to give your money back as he/she has your money after all and didn't have an item to sell. Also if you have a paypal account go into it and open up a dispute and make a claim back through paypal, but you need to do it asap because if you leave it to long paypal will tell you that you should have done it earlier and will not help you. Once the dispute has been opened with paypal give the person a few days to respond to your claim and then if you don't get a refund go back into the dispute and take it further and the seller will then have no choice but to refund you. Hope this helps.

If you paid through paypal then you might be able to get the cash back straight away by recalling the money - I'm not too sure how it is done but it comes up on the ebay discussion boards quite often. At least then you'll have the money back. If you didn't pay for them through paypal then I think you'll have to resign to yourself that you have lost the cash.
It seems strange that ebay isn't taking this seriously as they are very keen to track down fraudsters. Are you sure that the seller has informed ebay that his account was hacked? Usually the hackers completely take over an account changing all of the details to get to the credit card info - ebay then allows the person who has had their account hacked the chance to set up a clean account but this doesn't appear to have happened in this case.

Look into Ebay help and you can find a section where you link to a live web chat, you have to be there at a specific time of day but you get to talk to someone live rather than just emails.
They can look into the account to see if it was hacked of the seller is just pulling a fast one.
If the account was hacked then the seller is entirely innocent and should not be held responsible for your loss, it is EBAY who at fault for not making the system secure enough.
Account hacking is becoming extremely common especially on Ebay.

if you send eBay an email..which you can do by going in to the help button on the top of the page...then contact us button which should be on the left hand side.
Write to them telling them everything that has happen, give the item number and the sellers id name.
they will look in to it foe you
you may have to wait for them to get back to you as i take it your not a power seller. But they do take this very seriously and they will help you.
do it straight away

you have to wait 7 days until you can submit a dispute against the seller! then you ebay should be able to sort it out! and even the sellers account was hacked (which I highly doubt) he still should be getting your payment! so if he's the one messing with you then you cant have your money back otherwise he should give you a refund.
if you want to shop from ebay in future be sure you buy from someone who has adequate selling history and more than 95% positive feedback if not 100%.
good luck!

There is really not much you can do.
I'm pretty sure ebay is not liable for such a dispute.
I know that if you sell something ebay will refund you the listings price but that is because they have hold of that money.
Whereby your money is held by the vendor... I'm pretty sure its between you and their honesty. Unfortunately.
Good Luck though

Contact both Ebay and the seller again
Try to explain the situation again to ebay and ask the seller if they will contact ebay to explain also.
However, it seems like a bit of a scam.

Ebay has an online help. You may need to do a search for it. But you can talk to someone direct online. You write back and forth on the computer. I had a problem that ebay could not solve until I actually talk with someone that way. And they got right on it. Give that a try.

You may have to wait a few weeks but you will get your money back if you claim through paypal.
Unfortunately this does happen occassionally. Don't let it put you off buying on the internet or ebay, it is usually very safe to do so.
