Can 2 different ppl use the same membership account for live
Ex. I have a live account for the year (gold) and my brother made one but it says that it wont have gold so can we both use the gold membership or no?

The Gold status is on a gamertag by gamertag basis.. for your brother's gamertag to have gold status and go online too he will have to purchase his own gold account..
The only way would be if you share a single account (only one person can play at a time) or for you to bring him online as a guest (he won't get his own achievements or gamerpoints)

Nope, but you guys can share the same gamertag on the same console, but you both cant use it at the same time tho.
