According to it stating that personal property be in his or her possession then your fiance has a right to that ring. There is nothing in that (assuming here) that says "because she paid for the divorce she can take what she wants" Basically it stating that whats his is his and whats hers is hers gives him all rights to that ring. You can go to small claims court over that and call it "stolen property" if she doesn't give it back. Just because she paid for the divorce it doesn't change what the court ordered. Why does she want the ring anyways?? It probably isn't worth too much saying that most cost around 100-$200 when bought. It's more of a personal value. Shes just doing it to irritate you both. So do what you gotta do and get that ring back.. because according to the court, its his!

This means if she has it, she can keep it. The rest of your question does not matter.

It is illegal, but is that all she's keeping?

I suppose I would wonder whether or not it's worth fighting over.
