Because most are Sociopaths of Pyschopaths and there is no medication for those conditions. Therapy is the only helpful thing and since they don't see anything wrong with themselves, they tend to not get therapy. Sociapathic and Psychopathic are personality disorders. They live for the moment and self gratification of that moment.

The law is designed for rational actors, that is, people who think through the repercussions of their actions before acting and weigh potential benefits (like stolen cash now) against potential punishments (like years of jail time). Some people don't do this, which is why the death penalty is not much of a deterrent; rational actors will not think "I am so mad I could kill this person and go to jail for 25 years to life, but man, I don't want to be put to death so I won't kill her."
Similarly, the criminal system has several purposes, including rehabilitation, general deterrence, retribution, prevention of future crimes by the same person (specific deterrence), and incapacitation (i.e., the person cannot theoretically commit crimes while in jail). Needless to say, there is much debate about the pros and cons of each of these approaches.

It's almost like an addiction. They know what happened in the past but think it won't in the future. It is both insanity and addiction. It never pans out the way you want, but there is always hope I guess. I am hard pressed to really understand it. I am not of a crimal life. It is against my moral and values by which I live. But I do know those who had little or no choices. Bad decisions followed. Still, it it no excuse. Thank God that Jesus will be the one to deal with it.

People don't act logicaly, they act emotionally. If I was logical I would be doing my take-home midterm instead of answering stupid questions on Yahoo. Under the philosophy of criminal law, there are several reasons for punishment such as:
1. Deterrant
2. Justice or retribution
3. In the case of incarceration or capital punishment, it removes the criminal from society
4. Rehabilitation - which wouldn't apply to capital punishment unless you believe in reincarnation.

For a punishment to deter it must be swift and sure. The death penalty is neither. Most violent criminals do not think about the consequences, if they think at all, nor do they believe they will be caught.

Leopards never change their spots. Who said the death penalty does not work. Britain, which abolished the death penalty years ago has seen a steady growth in gun crimes and murder
