Split it 50/50. Right down the middle. Once it's made legal the woman usually gets more (if kids are involved). Divorces are not fun, I know from experience.

The one earning more money pays the spousal support. In Pennsylvania this is only until the divorce is final. Whoever gets the house gets the mortgage and buys the other person out of their half of the house. If you really want 50/50 neither should get the house - it should be sold, the mortgage paid off and the proceeds split equally. However, if you cannot agree on this or who gets the house then it should go to the one who can afford it or the courts will decide which could cost both more in the end.

If there are children involved the main care giver should live in the house if it is affordable for them to do so and take over pmts. If this is impossible then the house should be sold, paid off and the difference split between the spouses and then go their seperate ways. The main care giver should figure into their support for the kids the cost of living. This all depends on how much money is involved in the divorce and what is split up equallly among the people getting the divorce. Sounds way to complicated. Think I'll stay married! Guess i didn't read the question well enough. If you get the house in a 50-50 then you get the morgage.

Impossible to answer based on the limited facts you've given. The person who gets the house takes over the mortgage. But whether you would even want the house depends on how much equity there is. If the house is already underwater, by all means, dump it on your spouse.

Who SHOULD get it? Well, there SHOULD be Joint Physical Care of the kids (50-50) and the house should be sold, the mortgage paid, and the equity split.
What NORMALLY happens? Over 84%of the time, the woman is granted primary care of the kids and can end up with the house. But, usually, the mortgage falls to her also.

The person that gets the house should be responsible for paying the mortgage going forward, and also needs to pay off the half of the gained equity to the non-resident spouse.

well if it is agreed then who ever pays it gets it or sale it and split the money and move on. share the kids and the home all the way down to 50/50 that is the way to do it fairly so good luck and sale the darn thing........don't try to be greedy.....
