I am in NY and need to take someone to small claims court that is now living in MA. He owes me 5,000. In NY the max is 3,000 but in MA it is only 2,000. If he lived here previously can I still sue him in NY?

You can sue in the court where the damage occurred. If the damage happened in NY, then yes you can file there.
