I had a paralegal serve papers, but she refuses to send acknowledgement of receipt. It has been documented in the courts of me filing, can I get divorced by default or lack of movement on her part?

That is the point. In most states, once served, if the defendant doesn't respond or contest it, the divorce proceeds.

When you say "she refuses to send acknowledgement of receipt" are you talking about your wife?

If so, then petition the court for a hearing date and have the paralegal attend the hearing to swear that the papers WERE delivered and when.

You have a witness that they were delivered, so you should get a court date and show up.
