You really need to see a lawyer. You want this problem to go away quietly into the night.

What the victim is doing is called blackmail: Threatening criminal prosecution to gain an advantage in a civil matter. It's illegal, but no one would prosecute him if in fact you did the deed.

That said if you did the burglary and you caused damage, you are legally responsible for the damage. If you ever got to court and were convicted, the judge would order you to pay restitution. Even if the DA didn't prosecute, the victim could still sue you and get a judgment against you.

I hope you have a good lawyer. If you are representing yourself, definitely tell the judge about this.

But if you did actually commit the burglary, then this would not be extortion, it would be a settlement offer, and perfectly legal.

hire a good attorney to handle your legal problem .when you go to court the court will decide weather or not you have to pay any restitution to the person who you victimized.if you have already been charged withthe crime then it is up to the court at this point if there is little evidence the grand jury may not indict you and your charge may be dropped.
