i didnt sign a release at school or my theripist for my mom yet she calls and leaves messages and they (the school and my counciler), still listen to them and then try and talk to me about it , the content of it is mostly problems at home , and so .. like legaly cant i sue or somthing , i never signed a release yet information is still being sliped back and forth , how can i stop this i am almost 20!

She does not need a release to TELL them things. She can leave a message and they can listen. Since she has provided the information to the counselor freely the counselor can discuss it with you. What law do you feel that violates?

Don't really understand your question. Any information you give to your therapist is protected under confidentiality and absolutely should never be told to anyone for any reason. Your school?? That information isn't protected per se, but the school certainly has a duty to take reasonable steps to prohibit unauthorized access.

Explain the situation a little better and I may have a better answer...

No, they cannot talk about anything you say to a counselor, to anyone. It is a breach of confidentiality. The only thing counselors have to report is if you are suicidal or homicidal, and then it is to the police. Try reporting to the APA, they will tell you what you can do. You are not a minor, so the school and the counselor must be reported. However, if the counselor is not telling your mom anything you say in therapy, but just relaying to you what she says, then no foul. However, you may request your counselor not to take the calls.

ask your therapist to review her confidentiality obligations with you. You can do this as often as you feel necessary. Then raise your concerns about the messages.
