When you can, you "take advantage" of a loophole.

When you can't but someone else can, theyre ' exploiting " a loophole.

No, it's expoliting a weakness or deficiency in those who are attempting to regulate your behavior. It's natural human instict to do this, and is different than using fraud or misrepresentation to avoid responsibility for something.
