My ex just caught up on back child support. She is not working right now, so I am wondering if she has some sort of ulterior motive, but I cannot figure out what that would be. Any suggestions would be helpful.

I have never withheld visitation from her. She was only about $700 behind. She's not working right now. Does she need to be caught up on payments to change how much she pays per month? or to file for custody?

Take it as a sign she is being responsible, and following the divorce decree. Also keep in mind that if she maintains the child support, she also benefits from the visitation agreements. If you were withholding visitation rights due to lack of payment, then now you cannot continue that.

Child support is a court-ordered obligation. The only valid excuse for not paying it is complete inability, e.g. no assets and no job and inability to get one. Otherwise, if someone is ordered to pay and doesn't, they can be sent to jail until either the child is at the age limit where the obligation to pay ends (18-22 depending on the state) or until they agree to pay.

When they do, they have to bring all prior obligations current or they can - and will - be sent back to jail. Cities, counties and states are getting sick and tired of having to provide welfare for kids of people who can pay child support, but don't, and are making them cough it up.

She is wanting to avoid jail time or having her tax refund withheld.

Back child support is debt. She's just paying off her debt.
