This could have been anyone.....I need to find out how to get him removed from the list per the new "romeo & juliet" law passed in July. I am a paralegal, but haven't studied much in this area and have been completely out of practice for about 10 years. Can anyone guide me on the steps that I need to take to get the court petitioned in Florida? Thank you so much.

If the female was under the legal age of consent, he is stuck. It was unlawfully consenual.

While underage sex is still a crime in Florida, the law which went into effect in July allows a judge to remove the sex offender designation in certain cases.

The victim in the case must be between 14 and 17, a willing participant in the sexual activity and no more than four years younger than the offender. The offense must be the only sex crime on the offender's record.

While I don't have a copy of Floida's statute, in other states which have enacted the statute, petitioning the court is the first step. This is NOT something to be done without an attorney.

Sorry, but dealing with this law is not a paralegal level task. You need to find an attorney with experience in dealing with this type of offense. Getting someone pulled off of the offender list is a very complex, long process. This not merely filling out forms and filing them with the court. This process requires much more legal work. You need an attorney who is an expert.

I dunno. My brother in law had the same thing happen to him. Her mom was the one that set them up. They broke up 2 weeks before her 18 bday when he found out she aborted their twins. He wasn't much older than her. I find it outrageous that the judge did this even though the mother set them up.

It will be hard, they are very tough on this.
