Unfortunately we got pulled over and he got a dui in my car. The police arranged a ride for me, and left my car at a parking lot. They put him in jail and got released after 8 hours now he has to go to court on Dec.3rd. My question is what will his punishments be? For 1st time offense and he has a clean record. He does not own a car he is only 24. He works for the city (it is a driving job he has his own truck) on the weekends. He has been with the city for a year now. He has a full time job elsewhere, and he is a server at a rest on sat and sun nights. Do you think the judge will be lenient with him because it was his 1st mistake? I told him I will help pay half of his monthly court fees..but what does a 1st time offense go through? What penalties should he expect? And will he loose his job for the city? Can't he get a restricted license and still work for the city? Please help he is freaking out and I want to help him by being there for him. But I want to know what to expect.

hes screwed, and u suck!!!!
hes gonna pay lots of court fees and fees for DUI classes, not too mention all the classes he will need to take, the job he is going to lose and the caltrans he will have to do!.

I read something that fines for DUI in California are around 12,000 dollars... so you better be ready to pay up, cause it was you who should have gotten the ticket and arrested. Afterall what are friends for.

Next time here a little advice....for both of you.

There are attorneys who specialize in handling DUIs in your area. Because he drives for the city AND many employer's require a totally clean driving record, he needs to get out of this charge. Call your local bar association and ask for a referral for a DUI attorney, look in the phone book, but find one.

Well I don't know CA laws, but in most states a first for DUI is 3month-1year loss of license. About 1,000-3,000 in court costs and fines as well as some type of alcohol awareness class. He may be able to recieve a work license, but you should be able to find out on CA DMV websight.

He will probably have to pay a substantial fine along with having his license suspended for a short period of time. He can opt to do community service instead of the fine, but I doubt he will receive jail time.

I am sorry you did not like the answers you got when you asked this question a few minutes ago. My answer remains unchanged. He WILL lose his job driving for the city.

He needs to get a lawyer ASAP to mitigate the damages.

And next time, remember about the Designated Driver...they don't drink!!
