I did once! Imagine my surprise when I called to check on the last support payment and heard it was over $3000!!
Child support enforcement took care of it for me. They did all the paperwork necessary for the IRS to seize it. All I did was get the check and cash it.

yes, the child support case worker has to report the past due to the IRS (only if they are more than $500 behind)... and have it garnished from their return, but! here is an exception... if your ex is married and their spouse has filed "injured spouse" noone can touch the tax refund... because it's her refund too if they filed together...

No but I had mine taken for my husbands past support. Is he more than $500 behind? If so the government will just keep it out for you and then send it to you. Is your ex married or single? If he's married his spouse could file an injured spouse and you would only get half of the return.

It used to be that the child support agency could take State income tax returns, and sometimes Federal returns.
These days, they usually can not take non-taxable income from a person.
If you need to collect overdue child support, talk to the agency in charge of collecting it in your behalf about courses of action they can take.

Yes, I did. I actually received his money, and his current wife's, due to the fact they filed jointly. He was in arrears, and the IRS doesn't take kindly to dead beat dads. We had an ongoing court battle, I think that's why I received his income tax money.

I received child support payments that way. If you know were your ex is then just let your case worker do their job. They will get it garnished.
