make the spouse (who did not take the loan or go to school) pay for 1/2? If anyone knows of where there is any legal information on this it would be helpful

The person who took out the student loan or loans is responsible for paying it/them off. A spouse does not incur any responsibilty for the loans.

It's a shame in certain circumstances that only the one that took out the loan is responsible for that loan. My girlfriend got student loans and her husband (at that time) used all of it to run for a government office. She never got to use it for her schooling but she is the one who is now having to pay it back and they have been divorced for 5 years.

The person who took out the loan has the benefit of the education paid by the loan, so they get to pay the loan, because they are assumed to be bettered by the education.
It's like buying a big tv. Whoever keeps the tv gets to pay the loan on it.

Student loans belong to the person who took out the loan, not to the marital couple. The person who took out the loan would be responsible for paying it back.

If you did not sign for the loans, I don't see a way you are responsible for them since it cannot be divided as an asset in the marriage. A judge may not see it that way though.
