Good question...however this poses other questions that must be answered and legislated on - such as:
- What constitutes and "Environmental Offense"? You may say wilfull pollution is an offense - so does that mean when I drive my gasoline powered car I am an offender? Or is it a case of what type of pollution, or the size of the release of pollutants?
- Is Electronic pollution an offense? If so, would cell phones and TV/Radio broadcasts be considered pollution? What about the emanations from Hydro lines?
- What about accidental pollution - where prevention measures are in place but there is a failure due to unforseen circumstances - such as an earthquake breaches a containment facility, or a tanker gets grounded in a storm?

It is not a simple issue and could involve a lot of time and make money for a lot of lawyers...

Mnay environmental offenses are crimes. There are a plethora of anti-pollution and hazardous waste mangement laws. Most offenses result in fines, but some actually have brough prison sentences.
