Here's the skinny: Federal Law says you must be 18 to purchase .22lr ammunition, your local Wal-Mart says you have to be 21 for them to sell it to you. Some locations make you be 19 to buy tobacco (I don't smoke, but thought it odd the sign said 19). Is it legal for them to age-discriminate like this?

As I see it, they're denying my lawfully afforded ability to purchase ammunition (again, don't care about the tobacco, that was to show they do it in other areas of the store).

I figured it would fall under their right to not sell anything to anyone for any reason, but it doesn't hurt to ask. I'll take my ammo business elsewhere. They lost in excess of $600 dollars a year from me with that policy...

Yes. They can set their own policies on that. You have the right to bear arms, and they have the right not to sell to you.

Given the legal static faced by stores even when they sell to 21 year olds, I don't blame them.

P.S. I am licensed to CCW in 4 states.

By law a company may choose to set a higher standard for their product than the law allows . Such as 22Lr ammo. But they can't legally go below federal standards . If you have seen this in one of their stores then you need to call the AFT nearest you and let them know whats going on and have it stopped . Walmart is also the biggest employer of illegals in the US . But it is cheaper for Walmart to pay the million dollar fines than hire legal workers and pay an honest wage.

They have the right to set required ages older than what the government requires

just as you see in many stores they will proof everyone over 35 or older that walks in no matter how old if you are buying beer

The age in NY to buy tobacco is 19.

They can't lower the government set age, but they can make the age higher. Alo, there may be state and local laws affecting this also.

Yes, they can refuse to sell ammo to someone under 21 if that's what they choose.
