Use a finish remover to remove the varnish/polyurethane/ whatever it is finished with and then lightly sand and clean with a tack cloth to remove all the sand dust. No need to sand it to death - just want to be sure the wood is clean & free of residue. Use an oil based polyurethane that has the stain combined with it - Minwax makes a good one - "Polyshades" - and apply as directed. Be sure and test a spot underneath or on the back of the piece first to be sure it's the color you want it to be.

The stain will not sink in unless you get all the old finish off. It is keeping the grain of the wood from being exposed to your new stain. That is a lot of work but it is the nature of wood finishing.

you have to take off all the finish... sorry!
you need to get thru the clear coat and the darker stain to clear wood.
if you wanted to paint it, you could just sand a little and go from there
