while he had the gun to my head he hit me in the back of the head with his fist 3 or 4 times. I looked him up on our local district clerks website and it shows that the charges filed against him are a class B misdemeanor. I thought the charges should have been aggravated assault. They are charging him with terroristic threats. I spoke to a detective and explained everything to him in my report to file charges and my statement was video taped, so there shouldn't be any confusion as to what happened. My question is this, are these charges against him correct or should I contact someone at the police department to get the correct charges filed against him.

Charges are sometimes based on what the DA feels will bring a posecution. The assault may have been a weaker charge.

The police don't file charges, the DA does. Call the DA and find out why they charged what they did. Probably it has to do with making sure the evidence that will be presented in court matches will stand up to the actual charges.

Overcharge and the guy walks completely.

You might want to speak with someone in the District Attorney's office. Sometimes, to avoid the cost of a trial, the DA will allow a criminal to plead guilty to a lesser charge. But I think you have the right to hear their explanation. Good luck.

Sounds a bit like a plea bargain - contact the detective and /or the District Attorney's Office and ask him for an explanation. You might also ask if there is a Victim's Assistance Coordinator with whom you could speak.
