OK. I'm reading this book "Lily" (very sad BTW) and in it the main characters Mother calls the cops on the Dad and says he beats her...thing is she is drunk and he NEVER laid a hand on her, the cops see she is drunk but because she is injured (she hurt herself by being falling down drunk) they arrest him anyway and say he will have to plead his case in court.
This book is fiction but I know art imitates life so I have to ask....is this true?? Could that really happen?

waswis...: I'm not making it sound like anything, I'm asking a question that was born of a story I'm reading--if you have a complaint take it to the author, Paullina Simons.

I think it could. The suspicious and need to accuse men of abusing women is high when the women makes accusations. However at the same time there is real abuse that goes on and on, is even reported and nothing is done about it.

Unfortunately, it happens all the time. But those cases don't always make it to court. The burden of proof lies with the accuser. When women lie about being abused, it makes it harder for the women who actually are in those abusive situations.

Any women that gets caught lying about this should be charged with filing a false police report, have to pay the court costs, etc.

a minimum of right here interior the US, women who've or are recent technique kin violence have an exceedingly sturdy help gadget. however the gadget can in basic terms do lots, and in maximum situations (different than severe violent circumstances) can't tension itself on an unwilling woman who would not prefer to help her very own self. State grants all varieties of counsel to victims and survivors - newborn care, college assitance, councelling, therapy, relocation, secure practices, criminal help, housing, to call some. What greater does one ought back out of it? Even the illegals are secure! the only irony is that for the period of all those, in basic terms the criminal immigrants have the least concepts. yet no one, be it a guy or woman, could tolerate any style of violence, that too from a greater robust half whom u depended on with ur physique & soul. It hurts the very middle of you, and no you may experience that anguish.

If there is a complaining witness, the police have to act and investigate. If the police cannot find evidence that the alleged abuse occurred, they may be able to refuse to make an arrest. Because she was showing injuries, the police would have to arrest the man. However, if later he can prove that she was lying, she can be arrested for making a false complaint.

Could it happen? Absolutely. False reports of abuse happen all the time. The source below estimates that 2-8% of reports are false. Of course, that has to be tempered by the number of abuse cases which are never reported and the number of cases which are found to be true (like this one probably would be) but aren't, because statistics in this area is not an exact science, but the short answer is sure, it could happen.

Yes that happens quite often. The same thing goes for verbal abuse being made up by the woman when it didn't occur, or occurred in a lesser degree than what she claims.

BTW That it has become so easy to place untrue accusations on men which others are so ready to accept as being true, this is one of the major reasons men are reluctant to enter into a relationship with a woman.

And you might want to check this web page:

And waswisgirl1, this isn't about women lying about crimes, this is about women falsely accusing someone (men in this case) of committing a crime. The only crime, then, is her lying to authorities.

Yep. But the Police can be clued up. A false accusation is a very serious business.

Lots of trouble arises from a true complaint. To make a false one, is scandalous.

oh sure HAPPENS ALL THE TIME- sad but true
Domestic violance is a serious matter. In this case the husband was most likely safer away from her.
My concern is leaving the children in the care of a person like that.-That is when the lawyers bring the children to give statements if they are old enough.

Of course it happens. But as I understand it, one poster seems to believe it's justified in certain cases. Like the Duke lacrosse players, for instance. They're all spoiled rich white daddy's boys, so it's okay that they were falsely accused of rape. Apparently, they deserved it. I'll have to remember that the next time some rich white woman is raped.

Filing false reports/lying to police/perjury are criminal offenses. There is a 'checking' mechanism in place. Fear of prosecution acts as a deterrent - not just here, but in other 'would-be' crimes. False reporting is a 'sin' of comission, and for reasons already explained, I don't think its very widespread. You can get your a$$ in very hot water if found out.

I think you can safely assume that by far, less actual abuse against women is actually reported than goes on. There is no deterrent in place for women NOT to report to police and so to commit the 'sin' of omission. No deterrent (the threat of punishment for NOT reporting), the greater the liklihood of the (not reporting) behavior.
