he has not payed child support in about 8 months for our 2 children and is behind about $3600-$4000. do I have to call someone to get this process started or will the child support agency just give the check to me, is he far enough behind 2 have his refund check taken thanks I new with the child support, btw I am in texas and I work full-time not trying to sit on my butt and collect just want him 2 help take care of our kiddos.

If his support is being deducted from his pay check, the support agency will know that he is behind. If he is sending you a check, you will have to contact the agency and prove that he is behind. What eventually happens is that they file the paperwork to intercept his refund and they will send that amount to you. It never hurts to contact the support agency to make sure that things are in progress. I applaud you for trying to support your children yourself and realize how difficult it is on one salary especially if you are paying day care. States are getting tougher on dads who don't pay but its a shame that it takes legal action to force adults to do the responsible thing for their children.

Yes, he is far enough behind for the state to step in and look at his income tax refund. If he is getting one, that is, and if he files. I would call the state office that handles this- you should have gotten a packet of info that includes phone numbers when the child support was set up through the state.
If you did not set up an account through the state, you will have to hire a lawyer and take him back to court for a judge to write an order to have the taxes to be reviewed and diverted to you.
From your past questions, I never thought you were sitting on your butt waiting for a handout! His children deserve his support to help make their lives better.

the state agency will do that. If you don't receive state aid, like cash, then you will receive it. Contact the courts or agency that determined child support asap as tax time is coming soon. Also if he hasn't paid in 8 months there should be a warrant out for his arrest. Check into that also. The courts have so many cases that sometimes things fall thought the cracks so it is up to you to let them know.

Only if your child support is court ordered you can get them to take the refund check.. But try it on your own if you like.. If he is that far behind you should have his check garnished too. But this also only works if the child support is court ordered. Get legal advise,, it will be money well spent in the long run.

Talk to the child support agency. Generally, states have the right to intercept income tax refunds to pay child support.

Personally speaking for me: When my ex was behind on child support...the child support office just did it for me - sent him a note that says it was going to be taken. .... (if he doesn't have anything coming back you won't receive anything) If he is remarried- the wife will most likely sign a form to get her part of taxes. (this whole process will maybe take 6 months) - before you will even see it. ((I know this because of when taxes were due, and when I actually saw the check for the taxes).
