My buddy is involved in a lawsuit against the people he use to work with. Everything is finally moving along after he was doing all of the work and investigations and whatever else. The paralegal assigned to his case is an a** but was pulled off the case during the summer so she could study for the bar. The person they gave the case to was freakin' great but was there only for the summer. The other person has been put back on the case-- and I swear-- I am not a lawyer but this chick is a real lazy idiot who f***ed up the case by not doing her job why it's dragged on so long. Could he ask the attorney he don't want her with the reasons? And if he says she is the only one what happens then?

Reviewing responses with bud and additional information based on Mary's response. Paid 3500.00 retainer and recently told retainer ate up and owes14K. Loser paralegal contacted him yesterday and said had to redo paperwork because she didnt' understand it. He tried contacting attorney to tell him he isn't paying for this work because she f***ed up again but no call not returned.

Your buddy can ask the firm to have someone else on his case instead of the current person. If they don't make the change, he can go to another law firm.

This is what I would tell the attorney if I was your friend:

1. I hired YOU not a paralegal.

2. I am paying a LAWYERS fee, not a paralegal fee.

3. Your friend needs to ask how much of his retainer is getting eat up in fees for so many new people to review the case, which is NOT a billable expense b/c he keeps having people leave.

4. If he cannot explain it or fix it, then you need to find another attorney that will also sue him for malpractice.

If attorney's intentions are not questionable then you should let him do his job. May be he will be slow but will not betray you but if you feel his intentions are not good, you should change him without late.

Its his attorney. If they're not getting the job done, fire them.
