No, of course not.

But it's not very good non-graffiti either. It sucks almost as bad as most of the real kind.

No, since grafitti is painted on real surfaces. Since the person that created your example did it within the safe confines of a digital file, he or she faced no risk of arrest and prosecution. Hence, no grafitti.

Depends, were you told by the owner/paid by the owner of the wall? Or no? If not, then YES! If the owner asked/paid you to then No.
