Do you think we can be evicted for this? She is a typical two year old going through terrible twos, with a possible health issue. She is very hyper and plays loud and the neighbors complain to the landlord. We think the landlord is saying its us fighting to save his butt.

You may not get evicted, as such, but you probably face non-renewal of your current lease if you do not manage to reduce the noise levels created by your child. Even if your landlord does not move forward with an early eviction, he's not going to irritate the other tenants by allowing you to remain beyond what he is required to do.

Do remember that, upon expiry of your current lease, the landlord has NO obligation to renew, for any reason. He can simply indicate a non-renewal and require you to leave.
