I don't know if any one is born homosexual or not. As far indulging in homosexuality is concerned, no doubt it is a punishable offence under section 377 Indian Penal Code as it clearly provides Unnatural offences: - Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
Explanation.-Penetration is sufficient to constitute the carnal intercourse necessary to the offence described in this section.
This is a cognizable, non bailable offence.

How can it be against the law for someone to be born homosexual . You either are or you arnt that would only be learnt in later life say your teens . what may and probably is against the law is the practice of homosexuality in India .

If DNA or chromosome tests can be run to determine the criminal poterntial and law is amended that on the basis of natal tests persons can be incarcerate then world will be better place to live ?????
But only problems will be Jails will have enough capacity to contain and provide for their upkeep.
