The judge orders us to go to mediation so the date and time was set up by the other side and so i recieved all the infomation in the mail and the appt. time so when i showed up for the appt. the other side never showed up. We waited for 30 minutes after the appt. time but otherside still no show.

the mediation was for parental rights termination and the other side wasn't agreeing to it. so that why the judge ordered it and like i said the other side set the date and time and not me but i still took the time off and did what i had to do to go and show up early and on time

I will find out soon. My parenting plan (court order) says that we have to mediate if we cannot come to agreements. My ex husband refused to mediate because he didn't want to pay his fee to do it. Since it was a court order and he refused I am now going to take him to court and he will have to answer to the judge as to why he refused to mediate. He said he could not afford it but yet he bought plane tickets for 7 people to fly to Florida for Christmas (the mediation was only about $200). I am sure the judge will love to hear this. Anyway, if it is a court order, it is contempt if they don't do as it says. It's as if they just dis-obey all of it.

Anytime someone ignores a court order, the judge can issue a "bench warrant" for the arrest of that person, or hold them incontempt of court and fine them or all the above . Depending on the judge. Also depending on "what you are mediating " t he other side that didnt show up may have just agreed to your terms without further deliberation to save money, or face. still depends on what you are mediating. It would be to your advantage to look up the term "mediation".

They are in contempt of court.
If it happens again, you might ask for summary
judgement in your favor.
It can happen at a trial so the arbitrator might be
able to do it as well.
