You are are hacker when you access information that isn't on the public domain freely avaliable to everyone and you do not have permission to view that information (passwords, payment ect.)

When you find yourself reading government papers you have no business reading; other people's email, bank account info, credit card info, when they last went to the doctor--aka ANYTHING that doesn't pertain to YOUR daily life; if you give malicious viruses to people you don't know (like I got once because I didn't want to talk about sex with a 14 year-old on ICQ. It destroyed my hard drive and took almost 2 weeks to repair plus cost me $200, and when he signed off he wrote "You have been hacked by Sir Hacks-A-Lot" under a death's head skull).
Since 9-11, the Department of Homeland Security is declaring it a FEDERAL OFFENSE, with sentences up to and including LIFE IN PRISON WITHOUT PAROLE. Ages of hackers will not count--even juveniles can be charged and sentenced.
If caught, prepare to pay fines, be imprisoned for anywhere from 5 to 20 years, or if the offender knowingly or recklessly causes or attempts to cause death from such conduct , a fine under US Code, title 18 or imprisonment for any term of years or for life, or both. Be investigated by the FBI (in cases of espionage, foreign counterintelligence, information protected against unauthorized disclosure for reasons of national defense or foreign relations, or Restricted Data), the Secret Service, the Secretary of the Treasury and/or the Attorney General. . Get into peoples accounts.
For example: E-mail, Messenger, Online Communities, Bank details etc..
Things you should NOT do.

well, a friend of mine left someone's hard drive a smoking mass of useless slag when he was done with them. and he was several time zones away. i guess that would constitute a hacker.
