Marriage is legally a government entity. That is why there are laws controlling marriage. That is why the government requires a license. That is why there are laws covering taxes relative to marriage. Sure people like to believe it is a religious entity but AS IT EXISTS IN AMERICA TODAY, it obviously isn't.
Whereas separation of state affairs and religious affairs is not specifically in the Constitution, the US Supreme Court whose job it is to decipher the Constitution has decided the Constitution requires such a separation. Don't forget, the US Supreme Court and their powers/duties were created through the Constitution.
But that isn't all that relevant to this issue anyway.
Many years ago the Supreme Court also decided that "separate but equal" is not equal at all. The case dealt with educational segregation. All those who wish to deny homosexuals marriage while calling it something else are in violation of that decision. You cannot have 1 couple in a marriage while a 2nd couple is in a civil union & say both couples are afforded the same legal protections & rights but they are just called something different. Separate but equal is NOT equal. PERIOD. You cannot separate one class of people simply because you do not like them. Even if you do not like them because your religion's interpretation of the Bible tells you not to like them. THAT is in the Constitution.
All those people upset and claiming homosexual marriage will ruin marriage, ruin the family unit, are simply unsure of their own marriage and family unit! If you are secure in your own marriage and secure with your family, the fact that the married couple down the street are both women will not effect your marriage at all. Homosexuality is not a choice nor is it contagious. Science has proven that as fact. [Real science - not studies conducted by religious groups.]
As for me, I am not homosexual. I have no reason to deny homosexuals the same rights my wife and I have. I do not in the least fear homosexual marriages will damage my family or marriage for I have confidence in my family and marriage.
We shall see just how many are insecure in their marriage.

The Establishment and Free Exercise clauses to the First Amendment of the Constitution prohibit the government from creating a national religion or taking preference to one religion over another. Thus ensuing separation of church and state. Sep. of Church and State DOES have a democratic precedent, as it is bound by the most legitimate document in our country. Religious views are fine, and what the bible may or may not say about homosexuals is all well and good. But the government cannot act upon these views, as it would be unconstitutional. The winning case is majority rule. But let us not forget that with majority rule comes mob rule, and with mob rule comes tyranny. The only reason for standing against same-sex marriage is prejudice, fear of difference. It is funny how easily we forget what our country was founded upon: fear of religious prosecution in England. Hypocritally, the majority of our country assumes the role of England, religiously prosecuting homosexuals by illegitimate means: through Christianity. Just as the pilgrims fled England and attained success, homosexuals will do the same and find vindication with same-sex marriage. Same-sex marriage WILL occur in this country at some point, and the majority of our country who stood against it will be labeled more greatly by prejudice than ever before

Well, seeing as how it mentions in the New Testament that God is againts homosexuality, I dont believe they have a right to marry. A marriage is a holy union between one man and one woman. That is what God created it for. In the beginning God created man, and created a help mate (which was a woman) for him.
Now, for those of you who do not believe in the Holy Bible as a valid guideline for living (which if you look for yourself, it has answers to all of life's questions), perhaps you should look at how the world has declined. It starts with people doing what they think is right only because it feels good to them. Which in this case, would be a lustful relationship, and not a valid reason to marry. Many marriages have been broken apart because they didn't have the right reason for marrying. It is nothing more that a horrible mutation of what God intended the marriage relationship to be. If you are going to live in sin, at least dont desecrate the holy sanctuary by vowing to 'love' and 'cherish' each other until death do you part. That may come sooner than you think... ( I John 2: 16, 17) The government does have several flaws, but it comes down to what is right. And not what you want. I'm sorry, but that is what I believe. You may be right. They may just be 'policing' their own morals, but I can guarantee you half of them don't use the Bible as their guideline. They just say you shouldn't because it has always been known to be wrong, and unnatural. And not because they believe in what God has to say about it. But, again, those who believe in God, and have the Holy Word of God as their book of rules, would tell you it is wrong. And that is where my standing is on it.

Homosexuals are free to marry, they just have to to marry people of the opposite sex.
Please tell me where in the Constitution or any law for that matter mentions separation of church and state; that is a myth.
The Constitution leaves everything not mentioned within up to the states.
I am not saying I am even against gay marriage. But you will have to achieve it through the democratic process. You cannot use fiat of the courts to accomplish this because there is not precedent no matter how hard you want to see it.
So get out there and win hearts and minds, then the votes will come.

This nation is 86% God believing! And about 90% of those believe it is wrong! Get over it, it's a Majority thing.
God made Adam and Eve not Adam and freakin Steve.
Gays are immoral to me, and need to forget marriage, because it just can not happen. It is an abomination unto the lord in my opinion. Some people go and get married in Canada, becz they're gay, and can't do it in the USA. Then they come back to the USA and say they are married. Unfortunately, legally in this country, they are NOT, therefore if anyone else is thinking of doing that.... don't bother. Becz. NO you will not see your partner at the pearly gates when you are dead.

Yes they should. It isn't even a matter of the separation of church & state. It is a matter of Equal Protection, which is guaranteed by the Constitution. Also, as Plessy v. Ferguson made clear, Separate but Equal is NOT truly Equal. The idea of Civil Unions do NOT equal marriage. For example, the federal tax benefits are not given to members of a "civil union" though they are given to members of a marriage. The same is a problem with intestate succession, adoption, child rearing, and marital property.

They're already allowed to be married, in terms of a ceremony. The only actual problem is registering it for the sake of taxes. If your love for another human being is dependant on a slip of paper for a beurocracy, then I'm very concerned for you.
Either way, I have no problem with it. As long as the states vote on it.

I agree. I can marry my fiancee in Vegas tomorrow night. We can have Dracula be our officiant. Or I can marry a guy who is an 80 year old billionaire, and just wait a few years before he dies and I can cash in. Or I can marry and divorce as many times as I can handle. Whatever sanctity of marriage exists in this country, I don't think two men or two women marrying is going to affect it.

Marriage is between a man and a woman. When the Romans began having orgies and idealizing homosexuality, their empire crumbled. Our American emire is unfortunately declining due to breakdown of the family among other things, but if we legalize gay marriage the decline will happen even faster.

Your question assumes that marriage is based on religion alone. What about people married by a Justice of the Peace? Marriage is a legal arrangement, but not necessarily a religious arrangement.
