My husband was drunk when we got married. Someone told me that because he was drunk our marriage might not be legal, anyone know if this is true?

yes he was drunk when he signed the marriage licencse, and I was told that because a marriage license is a legal document someone drunk cannot legally sign it

after the marrige when he was no longer drunk-was he happy to be married to you? if yes then yes your marrige is legal. and stop telling people your bussiness about you and your husband

Some people here are leading you wrong.

A legal marriage (or any contract) requires parties competent to enter into a contract. Being drunk makes one not able to enter into a contract (including marriage).

If you consummated on the wedding night, and he was drunk but you weren't, then you committed rape because he wasn't legally able to consent at the time. ☺

Now, the question you have to ask is 'how intoxicated must one be to be incompetent and was he that intoxicated'

For your peace of mind - if he hasn't complained yet then he's got no standing to complain. He'd have had to complain immediately when he found out he was married but had been incompetent. He'd then have to assert that getting married was not his intention. You're married. ♥

comment: if this was a woman saying "he got me drunk and then married...." would the answers all be saying "yes, you're married?" bunch of sexists here?

If he's been married to you for a while, and actually wants to be married to you, it's legal. The only time this would be an issue is if someone got married and immediately tried to dissolve the marriage, claiming they were impaired and didn't mean to do it.

So... he probably COULD have claimed he was drunk and tried to void the marriage contract, but unless he did that, the marriage is legal. By staying in the marriage while sober, he is showing that he still agrees to the contract and wasn't influenced by alcohol. It's probably too late for him to void the marriage for this reason even if he wanted to.

The thing is, people (drunk) get married in Las Vegas, every day. It's the officiant's obligation to discriminate. If he was allowed to sign in this case or in any case, you are married. I've never seen a judge say, "Oh my, I guess we have to find a way to validate your marriage now that I understand that one of you was drunk..." How many times have you heard, "I did X, Y and Z because I was drunk!" It's just not a plea.

There has been many people married before with either the bride or groom drunk, I haven't seen a law anywhere stating that being drunk during your wedding would make it illegal, and if you ever get divorce the judge won't ask if you or your husband was drunk at the time of the wedding because it doesn't matter.It makes no difference if he was drunk or not.

Well, all I could find is it isn't legal in Georgia if one of the participants is drunk. You need to call a lawyer or legal aid in your area and find out for sure. Of course, if he is still amenable to the marriage after he sobers up, I don't see a problem.

No, your marriage is 100% legal, even if he was drunk. If you have a certificate of marriage you have nothing to worry about.

This is interesting. My guess would be YES you are legally married. The marriage certificate should clearly certify you to be married with this man along with the witness' signature.
