If someone moves out of the marital home, they have the same rights as the person who remains in the home. By law, they are still entitled to enter the home using their key, the person who remains in the home has no right to change the locks to prevent this happening. This right remains until divorce and a settlement has been reached.
Being the one to leave the home does not mean they will lose out financially, a good thing when so often a women has to leave when domestic violence is the reason..

personally, I believe that the kids should be left in the marital home and the parents come and go to accomidate the kids. Why should be kids be shuffled of here and there when it's the parent's who have created the situation.

who ever leaves the family home looses loads of rights. because the other one still has a home for the kids... once you leave you instantly loose the right to return , as you left.
look on the farthers for justice web site urgantly... it works both ways... women can read advise too.
