I am a 5'8" 300lb female and I work in a call center. I have been off work since Monday. When I went to work last night I found that my chair had been taken away and in place of it was a new chair. Unlike my old dusty purple colored chair, this new chair was bright red and doesn't have any arms. I asked my supervisor what happened to my chair and she said she didn't know that some peoples chairs were changed. Upon looking around the only chairs that were different were that of the people who are my size and larger. I asked why this happened and was told that it was a safety issue. On the side, another employee said that they heard that it was because we break the chairs. I have been sitting in the same chair for the past 3 years. I feel like a target in this big red chair with no arm rests. I want to get my old chair back or have other people have chairs like mine. What can I do?

That isn't discrimination....if ANY of the larger employees were breaking the chairs, and there is a fall risk associated with it, and the EMPLOYER KNEW that there was a fall risk, then they can be HELD LIABLE if they don't change out the chairs.

What it sounds like they did, was to change all of them out....you may not have had anything to do with why they made the decision, but someone else may have.

If it was for your safety, you can't do anything about it. That isn't discrimination.

Nothing it sounds like a safety issue. The company does not want to be held liable if your chair breaks. Sorry but you will just have to accept it.

is the new chair uncomfortable or otherwise unsuitable? if you are simply embarrased to have a different chair I don't think that's actionable. you have to understand the difference between things that really impact your ability to earn a living and things that bother a sensitive person. the boss has the right to give you any sort of chair they want. other people there may not even notice the chairs.

This new chair may be better than you think. Use it for more days be4 you determine whether it fits your size and how comfortable you are. Safety first before comfortabilty.

You can't do anything. And size isn't something covered by discrimination laws, by the way.
