My sister and daughter also get social security checks, my sister has not worked for the 13 years that they have been married because they had plenty of money to live off of, now they are getting a divorce. He is kicking her to the curb with no where to go...can he do this? What can my sister do?

Her daughter is not her husbands. He just has been taking care of my sister and her daughter for the past 13 years. The real father pays child support but only $100 every two weeks. We all live in the state of FL. My sister doesn't have enough income to stay in the house they live in currently and they rent the home. The disability check he gets is because he worked at Chrysler in MI and he severely hurt his back. That is also why he gets a pension. He actually was in a psych ward and they helped him get out on his own to get an apartment and told her she needed to get out of the house they rent because she can't afford it, and gave her only a week. (as she doesn't have money to pay the rent)

What needs to be done is speak to an attorney, but I think she will be allowed alimony.

By pension check , are you referring to some sort of "retirement/investment" check. If yes, then Your sister should be able to get some sort of alimony. Depends on the state you live in. And why is SHE leaving the house? (I'm assuming when you said -"kicked to the curb ) She needs to stay in the house w/ her daughter and let him find a place to stay. She may have pinch pennies until it all gets cleared up through the courts. But she may also want to seroiusly try getting a job if she is able to work at all. It will defiantely make her look better in court. Good Luck !!

She needs to get a good lawyer! I am not sure if she can get any of the disability. That is for him being unable to work. Ya know? This is why she needs a good lawyer. He can answer these questions & fight for what she IS entitle to. Now a days even alimony is awarded on a temporary basis, but since he is "kicking her to the curb" she can file for divorce on the grounds of abandonment and possibly be entitled to some monthly monetary compensation from him.

I don't believe in alimony. I do believe in child support. But if you want out of the marriage, get a job and support yourself and give the guy a financial break.

If your sister is healthy and able to work most likely she will not get alimony.

If her daughter is a minor she will get child support.

She will get 1/2 of any property they own if she lives in a state that recognizes community property.

Yes you can get half, especially if he is leaving you. But if you are the one leaving, with good reason you can still get alimony from his check.
