Oh yes! It's not tattoo ink and can cause all sorts of infection problems on you.

It is not the ink. It is in penetrating the skin that infections can arise. Otherwise, any leaking pen would cause problems.

if it goes beneath your skin, yes it can. writing/drawing on yourself occasionally probably wont do much (i do it sometimes myself haha) but try not to make a habit out of it.
