Because I said a derogatory word to them? The problem is that the gang consisted of hispanics, blacks and white kids. What should I do.

What charges get filed are a matter for the prosecution. You can request that they look into it as a hate crime but that doesn't mean the circumstances will suport the claim.

The definition of a hate crime is different depending on where you live. Typically, it involves a crime comitted because the intended victim belongs to a group hated by the perpetrator. If this gang attacked you primarily because you are not Hispanic, black or white and used racial slurs about your ethnic group then that would be a hate crime. If they attacked you because they're a bunch of punks looking for trouble then it's not a hate crime.

Personally, I think the hate crime laws are useless. I don't see why beating someone while calling them nams should get more attention than beating someone without calling names. Physically attacking another person is an act of hatred. All such acts should get equal penalties.

From what you are saying you started this with your comment , were charges filed and the teens arrested for assault ? If you paid a lawyer and did pursue a lawsuit , is there any money to be gotten ? Do any of these teens have parents sitting on an nest egg ?

I am no legal expert but that situation does look a little fuzzy for hate crime. How about just the original assault charges? Prosecutors are getting tougher on youth violence and if any of those kids belong to a street gang, gang enhancement charges could apply.

It would be impossible to file a hate crime lawsuit in this case if you weren't part of the minority races.

However....

You can still file a lawsuit against them for pain and suffering you got from the beating (perhaps a "punitive damage" lawsuit), even without a hate crime involved.

Maybe a lawsuit, but not a hate crime lawsuit if you are the one that was derogatory towards them.

My very own opinion is that a hate crime can in basic terms be referred to as that if it may shown that race, faith, or gender became a important clarification for the altercation. however the sheer certainty that a combat breaks out and it occurs to be between 2 human beings of diverse races does not immediately propose this is a hate crime. in spite of the undeniable fact that, interior the Jena 6 case, i think of you're top. Any time you bring race into an issue you get nut jobs coming out of the walls. I think you might do better if you file an assault charge.
From now on, you might want to keep your derogatory thoughts to yourself.

If you said a derogatory word then you deserved to be beaten. They should file a hate crime lawsuit against you. You are totally in the wrong and have no repercussions.
