I have a tree in my backyard that is actually the neighbors. However, it is leaning so far into my yard that it is bending the fence. I want to cut it back so far that it is basically the trunk. That way it won't take my fence down. I am only taking the portion down that is on my property. Are there any issues I should consider? Does my neighbor have any say in this?

Yes techically he owns the tree, however becasuse hes the owner he is responsible for any damages it may cause.
Contact your local extension office for any more info.
Whatever you do dont cut his tree down ( you might have to buy it)

Talk with your heighbor about how the tree is damaging the fence. Recommend that the tree be cut down and, if necessary, you'll help pay the costs (or do the work). If he/she is a good neighbor, they should realize that the removal of the tree is required to prevent further damage on the property.

A couple years ago, my neighbor's maple tree got so big that it was blocking my view. A friend of mine who does tree work was over one day and I mentioned it to him. He went over and looked at the tree, and its roots were cracking a concrete stairway and running under the foundation. He said it would continue to damage the stairs and possibly crack the foundation if it was not removed.

I then brought this up to my neighbor, who agreed that the tree should be cut down. He was glad I brought it up, because his wife liked the tree (leaves turned colors every fall), but he couldn't stand having to clean up the fallen leaves all the time. So, he was glad he finally had a legitimate reason to get rid of it.

You can trim the branches that are on your side but you are not allowed to go and cut it down to the trunk.. He is liable for any damages his tree causes... so if the fence falls down he'll have to pay and put up another one.. You should go and talk to him about it.. He might agree and cut it himself..

Have you tried talking with the neighbor ?? He mught even assist you
