Because the authority of a marque and reprisal letter lies with Congress(its an enumerated power); not the president. There is no way Bush would give up that power to Congress. He wants to run the whole show.

Btw, this is the current form of this Constitutional right. Congressman Ron Paul has been attempting to change it since 2001 making it also a power of the president... that way it would apply to detainees.
