my question is this: does employee get earned but unused vacation pay upon termination of employment?

In most companies, the employer will pay you for unused vacation if you give notice prior to leaving on good terms. I think if you are terminated/fired, then it is up to them, and most will not pay the employee.

Answer to your other question: It depends on your company policy, as well as state law. Some companies will have a "use it or lose it" policy, others will cash you out across the board, and some have policies which fall in the middle.

Probably because the vast amount of "labor" in the US does not even receive anything called "vacation pay." Consider yourself fortunate if you are among the minority who does.

I think most companies would pay for earned (but unused) vacation pay. Mine did. Ask your HR mgr.
