In most companies, the employer will pay you for unused vacation if you give notice prior to leaving on good terms. I think if you are terminated/fired, then it is up to them, and most will not pay the employee.

Answer to your other question: It depends on your company policy, as well as state law. Some companies will have a "use it or lose it" policy, others will cash you out across the board, and some have policies which fall in the middle.

I think most companies would pay for earned (but unused) vacation pay. Mine did. Ask your HR mgr.
