Do I have a case, if I now, post-maternity leave, find myself in a new department? The company claims they couldn't afford to keep me in that department. Meanwhile, there have been a few new hires (one significant contract and one jr FT employee) hired since me. The new junior FTer was groomed to take my job while I was out.

I returned to my position after maternity leave. One month after my return, my position was eliminated. Just seems like too much of a coincidence to me that my boss told other staff members she wanted me out, and she got her way.

You're protected from losing your position while on maternity, but they don't need to provide the exact same. When you return, they are allowed to offer a lateral/similar position to you. Not much you can do about that, unless you look for another job.

Do not always trust "the grapevine" for true answers

I think legally the only thing they are required to do is to have a similar job to the one you had when you return from maternity leave

Sounds like they also need to get your job done while you are out

Well, they do need to fill your job while you are gone, so at least they are planning on having something for you when you come back.

Thuis happened to a girl who works for the same company as me, she left for maternity leave but when she came back they gave her a different position as the one she held needed to be filled immidiately while she was gone.

Your job had to be done while you were out. Nothing wrong there. They moved you to another department which means you still have a job. I cant see any case for anything with the facts provided.
