I could't spot "it" on this question. LOL, it took me a while.

Yes. They made a conscious choice to put the alcohol in their system and at some point made the decision to drive. Even if that decision was "clouded" by the alcohol.

Personally I think most drunk driving laws are too lenient.

Looking at this another way...
So if your stance is that they should not be fully responsible (I am not saying it is - you don't give your opinion in the question) if they drove drunk and something happened what about if they killed someone in a bar fight when they were drunk. Should they not be held fully accountable then?

Being drunk is not a defense.

Yes because they made the choice to drive drunk., hence they are accountable for their actions...
If they are not smart enough to know that they shouldn't drink while driving then they shouldn't have a drivers license.

is there a reason that they shouldnt be?

oh yes, because in this great nation if you are a complete idiot you can use that as your defence. "I couldnt control my actions becasue I was under the influence" Well if you have that little self control then maybe you shouldnt be allowed to live in our society and put our Citizens in danger. You should be locked away until you can control yourself.

Yes, driving under the influence is a voluntary act. It is not the wisest of choices, but it is a choice and the consequences remain.

YES.

I was drunk is not an affirmative defense for ANY crime. You willingly put yourself in that condition in the first place.
