Just wondering if there is any tenant laws keeping a lanlord from terminating your occupancy when you have a small child in winter?

There are no laws regarding eviction from a property, especially if you are in violation of lease.

You can be evicted regardless of pregnancy, small children, disability, etc.

Massachusetts is a very tenant friendly state and the courts will allow a tenant a "stay", which just holds off the actual set out for a few months.

The tenant must cure the lease violation, pay any owed rent and pay for use and occupancy in order to get a "stay".

If you don't pay the rent, or commit some other violation of the lease, you're history any time of the year. Do NOT, on pain of pain, allow an attempted eviction action to go to court -- move out first. If you get an eviction judgment against you, you will find it almost impossible to rent another place.

If you signed a lease stating that you'd follow some rules and you are in violation of those rules, it doesn't matter when they decide to evict you.

You may want to discuss this rationally with your landlord and agree to make some changes. You may be able to apeal to their sensitive side.

Otherwise, you may need to start looking for another place really quick, and at least get your child to a family member during the transition.

I've never heard of that one..but where I live (Canada, Manitoba) you cannot evict someone with a child during a school year except for serious lease violations and even then there must be a hearing first.

There are no laws if you fail to pay the rent; if you are indigent visit with your local welfare case worker or townships trustee to see if you qualify for any benefits that will keep you in the existing home or alternative Section 8 or co-op housing.

If the rent is not paid, YES.
if they just dont like you, NO

It has nothing to do with having a small child.

Most leases state thet they must give you thirty days notice if they just want you out.

Pay your rent. Why should your landlord have to keep you and lose money? Do you know that he/she has a mortgage to pay? Are they your mommy or daddy? No? Then go home to mommy and daddy until you can pay your own way. Your landlord is not running welfare!

I'm guessing that they can. I know that you can keep the power / gas company from disconnecting you in winter but I don't think you can stop a landlord from making you leave.
